Cap-Exempt H-1B Employers: Skip the Lottery Entirely

Universities, nonprofits, and government research organizations are exempt from the H-1B cap. No lottery required. Here's how to find them.

What is H-1B Cap Exemption?

Every year, USCIS limits new H-1B visas to 85,000 — 65,000 in the regular cap plus 20,000 for US Master's degree holders. When demand exceeds supply (which it has every year since 2014), USCIS holds a random lottery.

But certain employers are completely exempt from this cap. They can file H-1B petitions at any time of year, with no lottery, no April 1 start date requirement, and no registration fees.

Who Qualifies as Cap-Exempt?

Three categories of employers are H-1B cap-exempt:

1. Institutions of Higher Education

Colleges, universities, and affiliated nonprofits that are accredited by a recognized accrediting agency. This includes community colleges, research universities, medical schools, and law schools.

2. Nonprofit Research Organizations

Nonprofits primarily engaged in basic or applied research. Think tanks, research institutes, and nonprofit labs.

3. Government Research Organizations

Federal, state, and local government research entities. Includes national laboratories like Argonne, Brookhaven, and Oak Ridge.

Why Cap-Exempt Matters

For international workers, cap-exempt employers offer significant advantages:

  • **No lottery risk** — your petition is filed and adjudicated without selection uncertainty
  • **Any start date** — not limited to October 1
  • **Year-round filing** — no registration window to miss
  • **Multiple attempts unnecessary** — if approved, you start

The tradeoff: cap-exempt employers (especially universities) often pay below market rates compared to tech companies. But for F-1 OPT students running out of work authorization, or H-1B holders who have been lottery-unlucky multiple years, a cap-exempt position can be a strategic bridge.

Strategic Use Cases

F-1 OPT students: If your OPT (or STEM OPT extension) is ending before your lottery selection, a cap-exempt employer can bridge the gap. You can work at the cap-exempt employer while continuing to enter H-1B lotteries with a separate cap-subject employer.

Multiple lottery losses: After 2-3 unsuccessful lottery attempts, a cap-exempt position provides immigration stability while you continue trying or explore alternative visa categories.

Researchers and academics: If your career naturally fits universities or research institutions, cap-exempt sponsorship eliminates the lottery risk entirely.

One Important Note

Working at a cap-exempt employer does not automatically make you cap-exempt forever. If you later move to a cap-subject employer (like a tech company), you'll need to go through the lottery — unless you've already been counted against the cap in a prior H-1B.
